On 14 December 2017, the QCA made its final decision to refuse to approve Aurizon Network’s proposed standard user funding agreement (SUFA) and UT4 draft amending access undertaking (DAAU), submitted in accordance with Aurizon Network’s obligation under clause 8.8.3(a) of the 2016 access undertaking (UT4).

In accordance with clause 8.8.3(d)(iv) of UT4, the QCA required Aurizon Network to submit an amended SUFA by 13 February 2018.

On 13 February 2018, Aurizon Network withdrew the UT4 SUFA DAAU and advised that it has published on its website a suite of documents referred to as a Reference User Funding Agreement (RUFA).

The QCA does not regard Aurizon Network’s publication of the RUFA to be a submission of an amended SUFA. However, the QCA proposes not to take any further steps on the SUFA matter under UT4. We have released a stakeholder notice which is available below.

On 10 August 2017, the QCA made a draft decision in respect of the UT4 SUFA DAAU.

We invited stakeholders to provide written submissions on the draft decision and received four submissions by 15 September 2017.

Following a request from stakeholders, we allowed an additional consultation period for stakeholders to collaborate, discuss and, where possible, provide joint submissions by 31 October 2017.

No joint submission was received from stakeholders. Aurizon Network made a supplementary submission comprising the SUFA template documents and amendments to UT4, consistent with its 15 September submission on the draft decision.

The Standard User Funding Agreement, or SUFA, is intended to provide options for parties other than Aurizon Network to finance the cost of railway expansions in the central Queensland coal network.

On 11 January 2017, Aurizon Network submitted, in accordance with its obligation under clause 8.8.3(a) of the 2016 access undertaking (UT4), the 2017 Standard User Funding Agreement draft amending access undertaking (UT4 SUFA DAAU) comprising a:

  • proposed SUFA template; and
  • DAAU incorporating amendments to UT4 that Aurizon Network considers reasonably necessary.

The QCA considered Aurizon Network’s proposal in accordance with clause 8.8.3 of UT4. In addition, the QCA applied the standard assessment process for a DAAU under Division 7 of Part 5 of the Queensland Competition Authority Act 1997.

The QCA conducted an investigation to decide whether to agree or disagree with Aurizon Network’s proposal in accordance with clause 8.8.3 of UT4.

We received submissions from two interested parties on the UT4 SUFA DAAU.
