Extension DAAUs

We published correspondence with Queensland Rail about the termination date of the 2008 access undertaking.

On 4 June 2015, we released our draft decision on Queensland Rail's April 2015 Extension DAAU. 

Five submissions were received by the due date of 12 June 2015, which are available below.

On 9 April 2015, we received from Queensland Rail a draft amending access undertaking (DAAU) to extend its 2008 undertaking’s termination date from 30 June 2015 to the earlier of:

1. 30 June 2016, or
2. the date on which the QCA approves a replacement access undertaking.

Under section 142 of the Queensland Competition Authority Act 1997, we must consider a DAAU given to us and decide whether to approve, or refuse to approve, that DAAU.

On 25 November 2014, we approved Queensland Rail’s DAAU to extend the termination date of its 2008 access undertaking by six months.

The 2008 undertaking now terminates on 30 June 2015, or the date at which we approve a replacement access undertaking.

On 5 November 2014, Queensland Rail submitted a draft amending access undertaking (DAAU) to extend its 2008 undertaking’s termination date from 31 December 2014 to the earlier of:

1. 30 June 2015
2. the date at which we approve a replacement access undertaking.

We sought comments on the DAAU and said that in the absence of stakeholder submissions objecting to any relevant aspect of the application, we would consider proceeding directly to a final decision.

We did not receive any submissions on the DAAU.

On 18 June 2014, the QCA approved Queensland Rail’s DAAU to extend the termination date of its 2008 access undertaking by six months.

Accordingly, the 2008 undertaking now terminates on 31 December 2014, or the date at which the QCA approves a replacement undertaking.

On 7 May 2014, the QCA received from Queensland Rail a draft amending access undertaking (DAAU) to extend its 2008 undertaking’s termination date from 30 June 2014 to the earlier of:

1. 31 December 2014
2. the date at which the QCA approves a replacement access undertaking

Under section 142 of the Queensland Competition Authority Act 1997, the QCA must consider a DAAU given to it, and decide whether to approve that DAAU.

On 21 November 2013, the QCA approved a DAAU submitted by Queensland Rail to extend the termination date of its access undertaking by six months.

Accordingly, the 2008 access undertaking now terminates on 30 June 2014, or the date at which the QCA approves a replacement undertaking.

The QCA invited interested parties to make written submissions on the DAAU by  12 November 2013.

Extension of Termination Date

On 5 November 2013, the QCA received from Queensland Rail a draft amending access undertaking (DAAU) to extend its 2008 undertaking’s termination date from 31 December 2013 to the earlier of:

1. 30 June 2014
2. the date at which the QCA approves Queensland Rail’s June 2013 draft access undertaking

Under section 142 of the Queensland Competition Authority Act 1997, the QCA must consider a DAAU given to it, and decide whether to approve that DAAU.

Extension of the termination date

On 8 May 2013, the QCA received from Queensland Rail a draft amending access undertaking to extend the termination date of its 2008 undertaking from 30 June 2013 to 31 December 2013 (the Extension DAAU).

On 8 May 2013, the QCA issued Queensland Rail with a notice of investigation and sought submissions from stakeholders. The QCA received two submissions from interested parties.

On 28 May 2013, the QCA approved Queensland Rail’s Extension DAAU. Consequently, Queensland Rail’s 2008 access undertaking now terminates on 31 December 2013.

On 30 October 2012, the QCA received from QRail a draft amending access undertaking (DAAU) to extend the termination date of its 2008 undertaking from 31 December 2012 to 30 June 2013.

On 30 October 2012, the QCA issued QRail with a notice of investigation and sought submissions from stakeholders. The QCA received one submission from a stakeholder, New Hope Coal Corporation, which supported the proposed extension.

On 22 November 2012, the QCA approved QRail’s proposed DAAU. Consequently, QRail’s 2008 access undertaking now terminates on 30 June 2013.

Extension of Termination Date

On 24 April 2012, the QCA received from QRail a draft amending access undertaking (DAAU) to extend the termination date of its 2008 undertaking from 30 June 2012 to 31 December 2012.

On 26 April 2012, the QCA issued QRail with a notice of investigation and sought submissions from stakeholders. The QCA received submissions from two stakeholders by the initial due date, the Queensland Resources Council and QR Network. QR Network requested that QRail’s 2008 undertaking be amended to show clearly that it no longer applied to QR Network.

On 6 June 2012, QRail submitted an addendum to its DAAU which removes QR Network’s logo from the cover of the undertaking and includes clarifying statements about the way in which the undertaking applies to QRail. The QCA published the addendum, and sought submissions, but did not receive any comments from stakeholders.

On 27 June 2012, the QCA approved the DAAU, as amended through the addendum. Accordingly, QRail’s 2008 access undertaking now terminates on 31 December 2012.

Extension of the termination date

Queensland Rail (QRail) is subject to the 2008 access undertaking the QCA approved for QR Network, as amended to include new tariffs and tariff-setting rules in June 2010.

On 21 April 2011, the QCA received from QRail a draft amending access undertaking (DAAU) to extend the termination date of its 2008 undertaking from 30 June 2011 to 30 June 2012.

On 27 April 2011, the QCA issued QRail with a notice of investigation and sought submissions from stakeholders. The QCA received submissions from three stakeholders, all of which either favoured the extension, or did not oppose it being granted.

On 19 May 2011, the  QCA approved the DAAU. Accordingly, QRail’s 2008 access undertaking now terminates on 30 June 2012.
