Queensland Rail 2012 Draft Access Undertaking

The Authority's consideration of this matter concluded on 25 February 2013 when Queensland Rail withdrew its 2012 DAU and submitted a new voluntary draft access undertaking (the 2013 DAU) to the to the Authority for its approval.

On 30 March 2012, Queensland Rail (QRail) submitted a voluntary draft access undertaking (the 2012 DAU) to the Authority for its approval. The 2012 DAU sets out the terms and conditions under which QRail proposes to provide access to rail infrastructure covered by the undertaking once its current access undertaking expires on 31 December 2012.

QRail is currently subject to the 2008 access undertaking that the Authority approved for QR Network, as amended to include new tariffs and tariff-setting rules in June 2010. The 2008 undertaking applies to QRail through a Transfer Notice published by the Queensland Government in June 2010 under the Infrastructure Investment (Asset Restructuring and Disposal) Act 2009.

Under section 136 of the Queensland Competition Authority Act 1997 (the QCA Act), the Authority must consider a DAU given to it, and either approve, or refuse to approve, it.

On 2 April 2012, the Authority issued QRail with a notice of investigation, under s.146 of the QCA Act, stating its intention to undertake an investigation.

On 30 April 2012, the Authority published an issues paper to assist stakeholders in preparing their comments on the 2012 DAU. The Authority received 8 submissions from stakeholders and, as several of them raised issues on which others had not commented, the Authority provided an opportunity for stakeholders to make further submissions on those matters.

The Authority has received six further submissions in response to that request.
