2009 Draft Access Undertaking

On 18 December 2009, the Authority published its draft decision to not approve QR Network’s 2009 draft access undertaking (DAU).

On 9 September 2008, QR Network submitted a voluntary draft access undertaking (the 2009 DAU) to the Authority for its approval. The 2009 DAU sets out the new terms and conditions under which QR Network proposes to provide access to rail infrastructure covered by the undertaking once its current access undertaking expires on 31 May 2010.

Under section 136 of the Queensland Competition Authority Act 1997 (the QCA Act), the Authority must consider QR Network's 2009 DAU and either approve or refuse to approve.

On 10 September 2008, the Authority issued QR Network with a notice of investigation, under s. 146 of the QCA Act. On 24 October 2008, the Authority released its Issues Paper on this matter which identified key issues from the Authority's perspective and invited written submissions from interested parties. The Authority received 12 submissions from stakeholders.

In its draft decision, the Authority set out clearly what it required QR Network to do to resolve the issues identified by stakeholders and the Authority. The Authority invited interested parties to make written submissions in respect of matters raised in or by the draft decision.

The Authority received ten submissions from stakeholders. The Authority will consider these submissions as part of its overall assessment of QR Network's proposal.
