2008 Access Undertaking Amendments + Activities
June 2010 Extension DAAU
On 11 June 2010, QR Network submitted a voluntary draft amending access undertaking (DAAU) to:
- extend the termination date of the 2008 undertaking from 30 June 2010 to 30 June 2011 (or in respect of the central Queensland coal network until the Authority approves a subsequent access undertaking provided by QR Network);
- introduce transitional arrangements in relation to the division of ownership and responsibility for the network between QR Network Pty Ltd and Queensland Rail Ltd (formerly known as QR Passenger Pty Ltd) during the extended term of the 2008 undertaking; and
- incorporate new reference tariffs and price-setting rules consistent with the Authority’s June 2010 draft decision on the 2010 draft access undertaking (DAU) pricing arrangements and incorporate minor consequential changes to the 2008 undertaking to reflect the change.
The pricing amendments, including revenue caps and tariffs, were consistent with the Authority's June 2010 draft decision. The transitional provisions and consequential amendments were necessary to give effect to the new tariffs and the proposed restructuring of ownership and responsibility for the rail network.
The Authority received two submissions in response to QR Network's June 2010 extension DAAU.
The Authority has considered those submissions in reaching its decision.
On 28 June 2010, the Authority approved QR Network's June 2010 extension DAAU. Consequently, the 2008 undertaking terminates on 30 June 2011 or, for the central Queensland coal network, when the Authority approves a subsequent undertaking. The new tariffs have been back-dated to 1 July 2009.
