2008 Access Undertaking Amendments + Activities

West Blackwater Reference Tariff

On 30 October 2008, QR Network submitted a voluntary draft amending access undertaking (2008 DAAU) to the Authority. In it, QR Network has sought to amend aspects of the 2008 access undertaking to provide for a new West Blackwater cluster, and reference tariff, for coal-carrying train services operating from the Minerva mine to the port of Gladstone (the Gindie-Minerva line).

QR Network's formal application differs from its preliminary application, of 1 August 2008, by:

  • providing additional information in relation to the proposed maintenance costs, including further addressing how non-coal traffic utilising the Minerva line has been treated; and
  • correcting Blackwater's revenue cap for 2007-08 and 2008-09 to remove the previous double counting of Minerva's common cost contribution.

Under section 142 of the Queensland Competition Authority Act 1997 (the QCA Act), the Authority must consider a DAAU given to it, and either approve, or refuse to approve, that DAAU.

On 7 November 2008, the Authority issued QR Network with a notice of investigation, under s.146 of the QCA Act, stating its intention to start an investigation.

Interested parties are invited to make written submissions to the Authority in respect of QR Network's West Blackwater 2008 DAAU. Submissions must be received by 5.30pm on 21 November 2008. The Authority will consider any submissions it receives within that time but not those received afterwards. Copies of QR Network's proposal can be downloaded below.
