2008 Access Undertaking Amendments + Activities
Extension of Termination Date
On 23 April 2009, the Queensland Competition Authority received from QR Network a draft amending access undertaking (DAAU) to extend the termination date of the 2008 undertaking from 30 June 2009 to 31 December 2009.
Under section 142 of the Queensland Competition Authority Act 1997 (the QCA Act), the Authority must consider a DAAU given to it, and either approve, or refuse to approve, that DAAU.
On 23 April 2009, the Authority issued QR with a notice of investigation, under s.146 of the QCA Act, stating its intention to start an investigation.
The Authority received submissions from Asciano Ltd, the Queensland Resources Council (QRC) and Queensland Treasury.
On 21 May 2009, the Authority approved the 2008 DAAU. Accordingly, the 2008 Access Undertaking now terminates on 31 December 2009.
