QR's Internal Coal Access Agreements
On 24 October 2006 the Queensland Competition Authority published the below-rail aspects of the access agreements between Queensland Rail (QR) Network Access and QR National for coal services.
In accordance with clauses 5.4(a) and 5.4(c) of
QR’s 2006 Access Undertaking, the published access agreements only include those elements of the access agreements that the Authority is satisfied are below-rail aspects of the agreements. In particular, at this time, the Authority considers that:
- the elements of the access agreements that QR’s access undertaking specifically identifies as not being a below-rail aspect of an agreement are not a below-rail aspect of these agreements;
- the origin-destination service level data is not a below-rail aspect of these agreements; and
- the average time at depot assumptions is arguably not a below-rail aspect of these agreements.
Accordingly, this information has been excluded from the published internal access agreements. In addition, the Authority has chosen, at this time, to not require that origin-destination contract expiry dates be publicly disclosed since that information may raise commercial concerns for some end users.
