DBCT Non-Expansion Capital Expenditure
On 24 February 2011, DBCT Management submitted a draft amending access undertaking (DAAU) seeking to revise the provisions for approving non-expansion capital expenditure (NECAP) under the 2010 access undertaking.
NECAP works are not designed to increase terminal capacity, but are undertaken to satisfy workplace, health & safety and environmental requirements or are beyond the scope of the operator's annual maintenance plan.
The 2010 access undertaking contains a streamlined approvals process for NECAP expenditure less than $20 million per annum to be included in the regulatory asset base (clause 12.10(b)).
DBCT Management's DAAU proposed to amend the 2010 undertaking to include a transitional provision such that the Authority could consider NECAP expenditure in accordance with the new streamlined process, even if that expenditure had been incurred prior to 1 January 2011.
On 25 February 2011, the Authority published the DAAU and requested stakeholders to lodge submissions by 9 March 2011. Stakeholders were also advised that the Authority may proceed directly to a final decision if no submissions were received. The Authority did not receive any submissions by the due date.
On 17 March 2011, the Authority made a final decision to approve DBCT Management's DAAU.
