2006 Access Undertaking Amendments + Activities
Extension of Termination Date
On 3 September 2009, the Authority received from DBCT Management a draft amending access undertaking (DAAU) seeking to extend the expiry date of the 2006 DBCT Access Undertaking from 31 December 2009 to 31 December 2010.
Under s.142 of the Queensland Competition Authority Act (The QCA Act), the QCA must consider a DAAU given to it and either approve or refuse to approve that DAAU.
On 8 September 2009, the Authority issued DBCT Management with a notice of investigation under s.146 of the QCA Act, stating its intention to commence an investigation.
The Authority published the DAAU, as required under s.143 of the QCA Act, and received one submission, from the DBCT User Group, endorsing the extension.
On 22 October 2009, the Authority approved the 2006 DAAU and accordingly, the 2006 Access Undertaking now terminates on 31 December 2010.
