Excluded Distribution Services - Exclusion Applications
Under the Queensland Competition Authority's Prescribed Services Determination, Distribution Network Service Providers (DNSPs)
may seek to have their services excluded from the form of economic regulation required for prescribed services under the National
Electricity Rules.
Oaky Creek Coal and Anglo Coal (Capcoal Management)
The Authority issued Electricity Distribution: Determination of Prescribed Services in September 2000. In the Determination,
the Authority decided that, initially, all services provided by a DNSP that were associated with, or ancillary to, access to that
DNSP’s network for the supply of electricity were prescribed services. The Authority also decided that any interested party could
apply to have services treated as excluded services, subject to satisfying a Contestability Test.
Oaky Creek Coal (OCC) and Anglo Coal (Capcoal) are registered DNSPs in respect of the networks owned and operated by each company
to support their mining activities in central Queensland. OCC and Capcoal applied to the Authority to have their network services
treated as excluded services, on the basis that neither DNSP has substantial market power.
Following consideration of the exclusion applications by OCC and Capcoal and the requirements of the
Authority’s Prescribed Services Determination, the Authority issued its Draft Decision in December 2006, in which it proposed to approve the applications.
The Authority invited submissions from interested parties on its Draft Decision to be submitted
by no later than 26 January 2007. As no submissions were received and the Authority was not aware of any other issues that would alter its earlier view, it has issued a Final Decision that the network services provided by OCC and Capcoal be treated as excluded services and that a light-handed form of regulation be applied.
