Warning Notice issued to Ergon Energy
The Electricity Industry Code sets Minimum Service Standards (MSS) to be met by Energex and Ergon Energy in relation to the frequency and duration of distribution outages.
On 16 November 2010, the Authority issued a Warning Notice to Ergon Energy pursuant to section 120S of the Electricity Act 1994 (the Act) on the basis of its failure to meet five out of six if its MSS in two consecutive years (2008-09 and 2009-10) and the Authority’s view that there was a reasonable possibility that it would again fail to meet its MSS in 2010-11. The Warning Notice stated that the Authority proposed to issue Ergon Energy with a code contravention notice under section 120V of the Act unless Ergon Energy fulfilled the requirements of the Warning Notice.

On 27 October 2011, following an assessment of information provided by Ergon Energy, the Authority decided not to issue Ergon Energy with a code contravention notice on the basis that it had met all three requirements of the Warning Notice.
