Complaint Against Kilkivan Shire Council
In April 2003, Mr John Parsons lodged a competitive neutrality complaint with Kilkivan Shire Council (KSC) pursuant to Chapter 11 of the Local Goverment Act 1993. Essentially, Mr Parsons complained that certain business activities of KSC did not comply with competitive neutrality principles in relation to the supply of road-making materials. This complaint was subsequently investigated, and a report produced on 4 February 2004, by a referee appointed by KSC. The referee found that KSC had not breached the principles of competitive neutrality.
In August 2005, following a request by Mr Parsons, the Queensland Competition Authority decided to review the decision of the KSC referee. The Authority has now released a Draft Report of its investigation and concludes that Mr Parsons' allegations do not relate to a roads business activity, and are therefore matters that the Authority is unable to consider further pursuant to Part 3, Chapter 11 of the Local Government Act.
The Final Report was released December 2005.
